A Story Of Learning Alex and AviTron
(Potential class action lawsuit)

This all started when we decided to leave a grid due to unsatisfactory issues, to where we moved all our inventory from that grid to AviTron after having visited many grids that allowed us to visit, and finding the performance and pricing acceptable for what we were looking for in what we wanted to do. We removed all those items from our inventory at the other grid because we felt it was not necessary to keep the items there since we had no intention of staying there and paying for something that did not function properly, as well as the possibility of malicious intentions toward us or our original creations.

Now, at the beginning, we were allowed to visit other grids and transfer items between accounts in other grids, and the performance was better than we had found at other grids, so we were quite happy. Me personally, I chose to try and help Alex, the owner of AT with suggestions based on my experience in these virtual worlds since long before I started in SL early 2007, and my having worked with computers before Windows even existed, a well as a savvy business mind also.

I tried to help by suggesting ideas, and Alex even told me a few of the ones he was planning, like having an advertising program to where people could make around $350 USD a month just for having an advertising billboard on thier sim for specific companies, to which never happened. All seemed well for quite a while, then things started to change. First, was the issue of Alex choosing to lock us in AT and not allowing us to leave and visit other grids, or anyone else being able to visit. This also included not being able to transfer things from one person to another person in another grid, preventing us from being able to take our intellectual property out of AT. Then there was the removal of Gmode, and closing the hypergrid completely, thereby preventing even being able to find any other grids.

Greed began to become very obvious as the motivation behind such actions, so as to try and lock people into AT, and giving them no way out, trying to force them to stay within AT in order to make more money. Then the next thing happened to add fuel to the fire, to where he then chose to remove the deal for all members to which we had fulfilled and rightfully should have been allowed to keep the free land after one year, taking away the free lands and everything we had rezzed in it, which included no copy items we had customized, and now could not get them back.

During this time and the last few months I had noticed more and more people becoming very unhappy with the changes, with some threatening to leave the virtual worlds completely because of this sort of crap taking place. I kept quiet so as to not upset the members of our group, even noticing how all of our co-leaders at the time, including me, were also becoming unhappy with the situation more and more.

Meanwhile, one of the Co-leaders of our group had suffered a very serious medical issue, and happened to be the one who made the payments for the land we had, and the other who lived in the same house was out of town dealing with a family member dying. I agreed to a deal with Alex to design the Marketplace for AT after I showed him the previous design I had been working on for the other grid before we left them. He loved it, and the deal he offered me land payment instead of monetary payment in the amount of 23 months fully paid for our land. The deal was, I would design the MP layout as fully functional, but that I would not do any database work, which included the database connection work as HTML, PHP or otherwise. He apparently did not understand, as he claims that I did not make a fully functional website, even after I showed it live, and it functioned completely, but not any parts that would require the database work.

I had explained to him over and over, in many different ways how it was not proper for me to do the database work, as I was not an employee of AT. This could present a very bad security risk for both myself and AT. I would have to know where the database was, and what was in it to do the database work. This is a very high security risk to all involved, the AT staff and customers, including myself, because it could easily be claimed that I did something bad if they made mistakes later after it was all turned over to them. He was still insisting I do the database work with an older database, putting the customers at risk that may still exist in the current database, and I had to remind him as stated when the deal was made, that I was not doing any database work.

He persisted trying to get me to do database work, against the original agreement. The real issue was his website person for AT was backlogged 6 months before he could get to doing the database work. He was still claiming the website did not work and even stated he had three programmers saying the same thing, which clearly told me those programmers did not know what they were doing concerning websites. In either case, he decided to cancel the deal, to which I informed him I had everything documented, and if he broke the deal, we would leave, as well as I would go public with all the information after he tried to state I owed him $600 for the months paid for from the deal with the other member was in the hospital and up to the time he cancelled the deal. I then also stated that I would sue him for the remaining unpaid amount as well, since he already had the website design in his testing server, allowing him to copy it all and use as he wished, even if the deal was null and void, because he already had it. I even went to the extent of showing him a method of how to connect any website design to a database later, and he still chose to be ignorant of that fact.

So, without revealing the actual statements made by Alex and the details of the agreement directly from the chat logs, as those are being reserved for the potential lawsuit, and the additional potential lawsuit in the matters of all our intellectual property being withheld by Alex and AT, prevetning us and our tentants from being able take what we have in our inventory (intellectual property) elsewhere, I am curious if there are others who might also want to be able to get thier intellectual property out of AT and use it elsewhere also.

The latter part I have mentioned in the matters of your intellectual property, being your inventory, I suggest we all join together in a class action lawsuit to regain what is ours to take where we want.

To Alex, I warned you, now you are about to see it get even worse than you could have dreamed of, because I am not done yet. ~Chopper

New developments;

Alex has chosen to allow us to transfer our inventory out of AT to another grid. At this time we are in the process of doing that, and once completed, this story shall be taken down. In the event it becomes incomplete delivery for all CoS members, this may come back up until the requirements are met to satisfaction.
